Mobile courts can run for 2 more weeks

The Supreme Court today extended its stay on the ban on executive magistrate-run mobile courts, validating its operation for two more weeks.

A six-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha passed the order following a two-week time plea moved by Attorney General Mahbubey Alam.

The apex court also adjourned hearing on three leave to appeal petitions filed by the government challenging the High Court verdict that declared mobile courts unconstitutional for two weeks.

The executive magistrates can run mobile court for two weeks following today’s Supreme Court order,  said writ petitioner’s lawyer Barrister Hassan MS Azim.

The High Court on May 11, following three separate writ petitions, declared unconstitutional the rule under which executive magistrates can run mobile courts.

On July 2, the government filed three separate leave to appeal petitions with the Supreme Court challenging the High Court verdict.

Lastly on July 4, the Supreme Court had extended its chamber judge’s stay order on the High Court verdict.
